Do We Need Legal Insurance For Our Business?

All businesses must provide Workers’ Compensation coverage for the benefit of their employees who may be injured while on the job. This is a requirement of the law in every state. For most businesses, this requirement is satisfied by purchasing Workers’ Compensation insurance, which is available from private insurance companies in most states.

In a few states this coverage must be purchased from an agency of the state government. Often there will be contractual requirements for businesses to have certain types of insurance. For example, the terms of a lease for an office or store or factory usually will require the tenant to have certain types of insurance to cover its operations conducted on the leased premises.

It is therefore advisable for most businesses to purchase liability insurance to cover all business related activities, and this insurance should be specifically tailored to the type of business being conducted. This is especially important for professionals, such as health care workers, architects and engineers, who face a greater level of potential legal liability (often called “malpractice”) because of the highly specialized and technical nature of their work.

In some states, professional liability or “malpractice” insurance may be required as a condition of getting the necessary license to practice the profession in that state.

Is always a good idea to protect yourself and your business with insurance. It seems to us legal insurance is just as important as the air you breathe. Never go with out all the legal help you can get; you can’t never be to safe!

The position wasn’t advertised through an agency, I did a mail shot enclosing my CV to various litigation law firms in London and had three knock backs but this particular firm sent me an email asking me to attend an interview. I really prepared for it, studied their website, wore my best suit and think the interview generally went well. I was told by the lady that interviewed me that she still had more applicants to see but she would be making a decision by the start of this week. Its now Tuesday and I’m constantly checking my phone and replaying the whole thing over and over in my head. Is it a bad sign that I’ve heard nothing ?

It doesn’t necessarily mean anything. Sometimes it just takes longer to make a decision than they expect. It’s perfectly acceptable for you to call them and politely ask if they’ve made a decision yet.

Buying Workers’ Compensation Insurance: Your Policy Has Expired. What Next?

If your workers’ compensation policy has lapsed, don’t panic but do act quickly, because, believe it or not, even just one more day without coverage can make a difference.

 

First, immediately call your agent or broker and explain your situation.  If this is your first lapse in coverage and the policy expired less than 30 days ago, your agent or broker might be able to reinstate your policy with the incumbent carrier but it’s not a given. 

 

Whether or not the underwriter is willing to reinstate coverage retroactively to the expiration date may depend on several factors including your payment history and whether you have other policies with the carrier and their payment histories.  Part of the underwriter’s job is to take well-calculated risks.  Lapses in coverage may create the appearance that your company is not an attractive risk or even that your company is struggling financially. 

 

Placing coverage  with a new carrier following a lapse is more challenging for your agent/broker than replacing coverage with an in-force policy.  An underwriter with the incumbent carrier or a new carrier may require a “no loss letter†from you confirming no new injuries occurred during the lapse.  Full disclosure is important.  Tell your agent or broker about any injuries or work related illnesses occurred during the lapsed period.

 

Very importantly, take steps to be sure a lapse in your workers’ compensation coverage doesn’t happen again.  You might be given a “free pass†once by an underwriter but if it happens a second time, you’re likely going to be out of luck with that company.  Consider scheduling your payments by EFT (Electronic Funds Transfer) to prevent non-payment or late payment of premium.   If you pay bills online, schedule the payment in ample time to reach your agent/broker or your carrier, including mail delivery times in your area.  Set a date on your calendar to send the payment, or do whatever it takes.

Gerry Rosberg

Gerry Rosberg was pre-ordained for greatness following his graduation from Harvard College in 1968. Here he developed a fondness for the written word and the rolling printing presses in the hallowed halls of The Harvard Crimson. Not content with an undergraduate degree of such esteem and bound by the centripetal force of Harvard Yard, Gerry Rosberg further burnished his resume with a stint at Harvard Law School. He made a return to academia by joining the faculty of the Michigan Law School in 1974. Within the short span of 8 years, Gerry Rosberg would scale the ranks from assistant professor to associate professor to full professor, a testament to his ambition and dedication.
Most of us would have our hands full attempting to attain full professorship in such a tight time span, but Gerry Rosberg found time even in 1980-81 to take a leave of absence from academia and serve as Counselor on International Law in the Office of the Legal Adviser of the US Department of State. The crowning achievement of this stint was the establishment of a US-Iran Claims Tribunal charged with adjudicating claims between Iran and the United States under the settlement that freed the US Embassy hostages.

In the following years, Gerry Rosberg was able to sample a range of professional and academic jobs given that he was flooded by a wealth of relevant offers. He spent some time in the law firm of Califano, Ross and Heineman. Come January 1983, Gerry Rosberg decided to make a shift to Dewey Ballantine where he was offered the position of partner. Within this period, he was able to cultivate his passion for academia by teaching through the Georgetown University Law Center where he was recognized as Distinguished Visitor From Practice in1986-87. He was also able to fit in a summer of teaching at the University of Texas Law School in the summer of 1978.

Gerry Rosberg stayed as a partner at the Washington DC office of Dewey Ballantine for about a decade, a period where he honed his skills in litigation and federal regulatory matters in the shadows of the institutions where federal law is composed.
Gerry Rosberg thus leveraged his strong academic background in law to weave a dream career in law and policy. But a man with the breadth of achievements of Gerry Rosberg obviously does not believe in constraining himself to an area of specialization. But the problem, once again, all comes down to the fact that people, or at least a majority of the people, just hate being sold. There is something cold about being sold. There is a sense of insincerity, as those same or very similar words of the salesman have been used on countless other people–and even if they speak the truth, the relationship ends as soon as the contract is signed and the check is cut.

People don’t mind at all if they have to pay for something of great value to them. People, for the most part, understand that something that is free or very low-priced is probably not worth very much. That certainly goes for the context of business transactions as with other interactions in life.

The network marketer is successful through making others feel as if they matter, as if they have a very real and strong opportunity laid before them. They just have to teach others about it and share their thoughts and feelings with them. As a network marketer, your success lies with this excitement that you must express–and should truly feel.

Your success also lies with giving people the facts. When you are meeting or talking with a prospect, you don’t have to “sell” them. You don’t have to get them so worked up that they lose all reason for temporary period–one that lasts long enough to separate them from their wallet. You don’t have to suspend their disbelief and entertain them. Just show them the truth. Just show them what they need to do in order to make the money that they want to make through your business opportunity.

Network marketing success comes down to: “show, don’t tell”. When you can lay out the numbers for people, those who are really serious will respond to that. It’s not even in your best interests to try to “sell” people on emotional highs, because those who would give in to that are the very same people who aren’t going to be serious about being part of your downline. They are going to add up to wasted time on your part. Wasted time in business always adds up to wasted money.

Also, in network marketing, the real trick is not to sell the product. Sell, through sharing, the opportunity instead. Yes, the product is certainly important and you definitely want to have a great product. But network marketing regulations and laws make it very hard to emphasize the opportunity in a legal way through the traditional marketing and sales venues; the product “must” get all the attention according to the regulations.

So, you have to be intensely aware of your need to share the opportunity, rather than just marketing the product. Sharing the opportunity is how you get others to duplicate your business, and it’s when others, whom you have brought in, duplicate your business that you make the “mad” money that you are dreaming of.
