Legal Insurance For Business

legal insurance for business
how do i start a dog walking business?

Hello i am leaving college soon and i really want to walk peoples dogs for a Living as its something i want to do. but im abit confused about the whole legal side.like how and what insurance do i need? Pet Business Insurance? and how much is it?..also what is an agreement between you and the dog owner and how do i do it??? will i need to pay tax? please can someone help me and if u r a dog walker how did u start???

Dogs are “in” these days. The pet industry is huge and only getting bigger and more lucrative. Dog walking is one aspect of this growing business. Here is how to get a start.

Step 1-Gather references for the dog walking service. You should have prior experience taking care of dogs before emBARKing on this venture. Ask the owners of the dogs you have taken care of for written recommendations and ask them if it is acceptable to them for you to provide their contact information to prospective clients.

Step 2-Get a billing system up and running. In the beginning you may think your billing method does not have to be structured or sophisticated, but you watch, business will build up and you will need to stay on top of clients and their payments. Excel and Quicken are two good programs to utilize. Quicken will help you (Quick Books) with taxes, workers comp, and other issues that may arise as your company grows.

Step 3-Seek legal advice. Many dog walkers perform their services under the table. While this is very lucrative and provides less of a paperwork hassle, it can be a bad choice. Walking dogs carries liabilities. You are responsible for the safety of an owner’s dog-you want to make sure your company, and not you, personally, are liable in the event of an accident. If you employ other walkers you must have worker’s comp. Ask your lawyer about the best way to go about setting up the business as legitimate.

Step 4-Get the right equipment. Dog owners will generally supply leashes and harnesses for their own pet, but you never know what will happen along the way. Always have extra leashes, harnesses, collars. Always have water and treats on hand for your dogs.

Step 5-Learn the streets. If you do not already know your territory, study a map of the streets on which you will be walking. You should not be distracted while you are walking the dogs-looking at a map can mean a misstep for you and/or Fido.

Step 6-Advertising is good, but word of mouth is the best. The pet community is very tight. Provide satisfied clients with your business card. Offer referral incentives to current clients (free dog walks, etc) to generate even more business.

Step 7-Dress appropriately. Dress in layers so that you can be prepared for any change in temperature or weather pattern.

Step 8-Lastly, hire help. The only real way to make money in any industry is to have people working FOR you. Hire reliable and honest workers who have experience with dog walking. Remember, you are only as good as your weakest employee. Be VERY discriminate when hiring. You are entrusting the lives of loved pets with these people.

Disability Insurance Disputes – Business Overhead

Business overhead insurance disputes can be crucial to the long-term success of a small business, partnership or professional practice. When a disability suit occurs, the business owner is hit hard with expenses, all the while losing valuable income from the halting of the business. Many businesses are forced into failure each year because they were denied valid business overhead insurance claims from their insurance companies. When a founder or key employee becomes totally or partially disabled, the business may be in jeopardy.

Business insurance is purchased to prevent major loss in the event something bad does happen, but will your insurance company live up to its end of the bargain, or will they deny your claim?
Business overhead insurance is a limited type of insurance that should pay benefits for a defined period of time (often up to two years). Without this assistance, it is unlikely that a disabled business owner can maintain expenses long enough to recover and get the business back on its feet. In a partnership, each partner may be covered under a separate policy, based on individual expenses.

When an insurance company denies a business overhead insurance claim, the insured’s lawyer must demonstrate to the court that the plaintiff is legally disabled under the terms of the contract and that expenses requested as an award were incurred during the time of disability. Your lawyer can help you interpret your policy and determine exactly what benefits you are entitled to. Depending on your unique policy, your elimination period, waiver of premium, choice of monthly benefit amount, choice of benefit periods and additional benefits should be reviewed and thoroughly explained. At David Share Associates, our disability overhead insurance lawyers are ready to fight to get you all the benefits you need and deserve to maintain a successful business.

There are time limits to all business disability insurance disputes and any delay in proceeding may be subject to a deadline. You should not delay in proceeding with your claim or obtaining legal advice to clarify these deadlines.H

Fco Travel Insurance Advice

The Foreign & Commonwealth Office (FCO) says that many people deeply regret not taking out travel insurance. They think their credit card accident cover, home insurance, or private health cover is sufficient. The reality is that you do not have appropriate travel insurance and you suffer serious injury or lose valuable possessions you will face harsh financial consequences.

The FCO has guidelines for what your insurance should cover in the event of an emergency or other problems you may experience while on holiday.

The real cost when things go wrong. An emergency abroad can be extremely expensive. If you need to be returned to the UK it could cost you thousands of pounds, unless you are adequately insured:

* £30-35,000 – air ambulance from USA’s East coast
* £12-16,000 – air ambulance from the Canary Islands
* £15-20,000 – scheduled flight, stretcher and Doctor escort from Australia

What should my travel insurance policy cover?

* medical and health cover for an injury or sudden illness abroad – more information on medical and health cover page
* 24 hour emergency service and assistance
* personal liability cover in case you’re sued for causing injury or damaging property
* lost and stolen possessions cover
* cancellation and curtailment (cutting short your trip) cover
* extra cover for activities that are commonly excluded from standard policies, such as jet skiing.

The policy should cover the whole time that you’re away.

Your policy may also have:

* personal accident cover
* legal expenses cover
* financial protection if your airline goes bankrupt before or during your trip.

Many insurers will extend cover if you ask them. If not, shop around for a specialist policy.

Common travel insurance policy exclusions

Always check the conditions and exclusions of your policy:

* most policies will not cover drink or drug-related incidents
* you must take reasonable care of your possessions or your policy will not cover you.

Travel insurance buying tips

* shop around to find a good price and the right product rather than opting to travel without cover
* cheaper policies will usually have less cover – for some the price seems most important, but is it worth the initial saving?
* consider annual multi-trip insurance if you make several trips a year – you’ll save time and money.

Cancelling or cutting a trip short

A good insurance policy will cover you for cancelling or cutting a trip short. Check carefully to see exactly what you’re covered for:

* accident
* illness
* pregnancy (unknown when you buy the policy)
* jury service or witness summons
* home emergency: fire, storm or flood, burglary
* redundancy
* strikes
* bad weather – affects the departure of flights and ships.

Ensure your policy:

* will refund the full cost of your holiday
* pays out if you need to cancel or cut short a trip because you fall ill for example
* covers pre-paid expenses such as excursions
* covers extra costs incurred to get home

And try to book through an agent that’s with the Association of British Travel Agents (ABTA), Air Travel Organisers’ Licencing (ATOL) or other credible Financial Protection Organisations.
Personal liability insurance

If you accidentally cause an injury to someone or damage their property they may sue you. Good travel insurance will cover you for personal liability.
Personal accident cover – disability and death

Travel insurance can cover a personal accident payment made for permanent disability or death.
Cover for stolen, lost or damaged possessions

You can normally choose the limit in your policy. Limits for single items such as cameras and jewellery can vary from as little as £250 up to £1000 or more. Check these limits are adequate and realistic.

You should report a loss to the Police within 24 hours. Proof of notification will be required when you make your claim.

All insurance policies say that you must take care of your belongings at all times. If you don’t, the policy may not pay out.

Tip: take as much care of your property as if it were uninsured.
Lost baggage on flights

Do not rely on compensation from an airline if it loses your luggage.

By law, airlines only have to pay a specified minimum value per kilo of lost luggage. This is unlikely to cover the full value of your things.
Legal expenses cover

Taking out legal expenses cover will help you to pursue compensation or damages following personal injury while you’re abroad – very important in countries without a legal aid system.
EHIC – European Health Insurance Card

Get a European Health Insurance Card (EHIC) for healthcare in European countries. Understand what it does and doesn’t cover you for.
Medical health insurance

Financial protection for holidays

Don’t get stranded abroad without a refund when your holiday company goes bankrupt – know what protection exists for you.
Credit card protection

Information on the financial protection offered to credit and debit card users.

Car Insurance Top Tips

The car insurance industry has got really competitive in the last few years, so prices haven’t really changed much. There are now over 100 car insurers to choose from, so there are some very good deals out there for those who are prepared to shop around. 23% of motorists still choose to insure with the same company as the year before, but they could undoubtedly save money if they did check out some other companies.

Motorists could be forgiven for not getting other quotes, it used to be a very laborious exercise involving long waits while getting routed through the call centre, and boring repetition of facts to sales advisors. Now, thanks to the internet, it’s all a lot more simple. Car insurers also offer extra discounts to people who buy online.

However, you need to consider the quality of the policy, not just the price:

• Check that your low quotation is not due to an extremely high excess.

• Check that you will get a courtesy car if your car needs to be taken in for repairs.

• Check that legal insurance cover is included, if you want it, and automatic windscreen replacement.

• Find out if there is an accident help line in case of an emergency.

It’s a good idea to ring the insurer direct to talk through the policy in detail before signing up online.

Money saving tips – recommended!

You can get a quote with over 40 car insurers if you input your details into a good car insurance broker’s website. You’ll only need to give your details once. Call the insurer with the quotation to check exactly what is and isn’t covered.

If you have a garage, then you’ll save by keeping your car there overnight. You’ll also make savings if you can keep your car on a driveway. This is because there is more chance your car being broken into or vandalised if it’s kept on the road.

Give your insurer an accurate picture of how many miles you do each year – you will save if you travel less.

Some occupations, like being a landlord, journalist or professional footballer (if only) attract higher premiums. You can save money if you work in finance or the civil service.

Get married! Men under 30 pay more if they’re not married – it’s just the excuse your girlfriend is looking for!

Under 25′s pay more, but you can get lower premiums if can put a driver over the age of 25 with a good driving record on your policy as a named driver. That person must be under 60 though, as premiums rise again at that age.

Agreeing to higher excess (the average cost is £100) will help lower your premiums.

If your car is not of a high value, you could get third party cover and make quite a saving compared to fully comprehensive insurance.

Pay as you go insurance is a new option for 18-21 year olds. It’s a recent development introduced by Norwich Union, in which you pay a unit cost per mile. The cost per mile is more between 11pm and 6am. You pay an initial fee of £199 to have a Global Positioning System fitted to your car, and then it transmits details of your mileage direct to Norwich Union. They send you a monthly invoice and you pay for the miles you’ve done!

Taking Pass Plus lessons to improve your driving abilities could save you around a third on your premiums. They cost £15 – £30 an hour and cover driving at night, in busy rush hour jams and fast motorway driving. You can find out more at www.passplus.org.uk . You can also improve your driving skills and make insurance savings with the Institute of Advanced Motorists ( www.iam.org.uk ).

Find out the insurance group of a car before you make the purchase. There are twenty insurance groups – the slower and less desirable the car (to criminals) then the lower the rating. You could make considerable savings by choosing a car in a lower insurance group.

If you want a high spec or performance car then you can expect to pay a lot more on your insurance. They’re a lot more likely to be stolen or involved in an accident. Making the sensible choice might be a bit boring, but it will be a lot cheaper.

Watch your speed. Most insurance companies will let you get away with a single fixed penalty fine but if you repeat the offence then your premiums will rocket.

Protect your no claims discount as soon as you can (usually after four years). It costs a bit extra but it’s well worth it.

Satellite navigation in your car will lower your premiums. Insurers have found that people concentrate more on their driving and less on trying to find their way, which means less chance of having an accident.

It’s a good idea to have an engine immobiliser or alarm fitted not just because it could help you keep hold of your car, it will also make you a saving of 5-8%.

If there’s two or more cars in the household, get them on the same policy to get a good discount.

Help. We were robbed over Christmas and had 3 laptops stolen, why can’t we claim on insurance?

Insurers are saying that because these items are ‘portable’ they are not covered. Where in the policy would this be mentioned?

It is frustrating because we have paid in way more than the value of everything taken over the years. To add insult to injury they said we can claim for a toy worth about £15, when the value of the other things is £5000. So laptops are portable but toys aren’t?

Can I contest this? What is my legal position on this?

Insurers will always try to wriggle out of things if they can.
Get a full copy of the Insurance Policy if you haven’t already got one. There are exemptions like individual items over a certain value. I believe laptops ARE covered if they are in the house (but not if taken out-like at University).
You can employ a claims adjuster (like the Insurers will employ a loss adjuster) but this will cost money.
As I say Insurers will try anything on-stick to your guns if you can find no exclusions in the policy. They will soon cave in-no need for lawyers.
I once claimed for the theft of a Hi-fi system (seperates). The Insurer rejected the claim on the grounds it wasn’t “furniture”. Look up the definition of “furniture” in the dictionary-it covers almost everything in the house. They paid out!
I bet they won’t renew your insurance cover!

Can I buy salvage cars from insurance auctions and then resell them as-is using a seller permit in California?

I want to know if is legal to use my sellers permit to buy totaled cars or salvaged cars at auction to the resell them (as is) in ebay. would i need a dealer license if I selling more than 5 a year?

I work for the world’s largest reseller of insurance claim, salvage, and theft recovery vehicles (see www.copart.com ). In order to buy this type of car, you have to be registered with the state you are buying in. You will need a business license, tax ID, dealer license and a Bid Card. A bid card is a photo ID that the DMV issues people who have permission to buy from a salvage pool. Buying this type of vehicle is not something you want to do unless you are a dismantler or rebuilder. reselling to the public opens up HUGE liability issues that the average person – or dealer for that matter – would be wise to avoid.

Car Insurance Florida

When you’re searching for car insurance, you always want to induce the most effective worth for your money. So, what’s the secret to finding reliable, affordable car insurance?

Look around for the simplest deal. Get many car insurance usa quotes from different insurance firms before you get or renew your policy. Insurance companies vary, so you’ll get a better deal somewhere else.

Don’t be afraid to switch. You can switch insurance firms whenever you wish, whether or not it’s in the middle of your car insurance policy term. If you find a better rate, switch and save.

There are 3 varieties of Automotive Insurance (take a look at the Car Insurance USA Hub website for the most effective deals from the top insurance corporations):

Third party, that covers your legal liability if you injury somebody else’s physical property (walls, vehicles, gates etc.) thanks to a driving accident.

Third party, Fire and Theft offers third party cover and adds on 2 useful items of cover – fire damage to and theft of your automobile, together with injury caused by a theft or attempted theft.

A fully comprehensive car insurance usa policy includes Third Party, Fire and Theft and in addition can purchase damage to your own vehicle in the event of an accident. There are many extras, too, for instance it will additionally give you cover after you drive other folks’s cars – useful if you borrow somebody’s car and their insurance will not cover you.

The following factors have an effect on what you pay for your premiums.

Your age, your job, your driving record.

The car you drive. The higher the value of the vehicle, the higher the premium. High performance vehicles also are more expensive to insure than their stock commonplace equivalents.

Then there’s the location of the car. You’ll pay more if you keep the automobile in a high-crime area or park it on the street at night.

What you use the automobile for. You will pay more if, for instance, you plan to use the automotive for business delivery purposes.

Then there is the excess structure that you simply choose. The higher the surplus the lower the premiums.

Gear Locks, Satellite Tracking – will help reduce your premiums

If you’re shopping for a replacement automobile ? Don’t forget to shop around for Insurance!

For a initial-time automobile buyer, the method will be a tough decision. Several patrons don’t seem to be aware of the actual fact that they have to have insurance before driving their new automotive off the showroom floor. The financial establishments providing the finance for the purchase will enforce this, in order to make sure that their new asset is protected.

Do not simply accept the primary offer that’s given to you, get a minimum of three quotes before making your decision. “Several banks or finance establishments are affiliated to an american car insurance company or brokerage firm. New patrons therefore might find themselves feeling pressurized to take insurance cover through the bank’s preferred supplier. It’s important to grasp that this can’t be enforced and the choice lies with the client. This makes it essential to shop around for competitive quotes, to make sure that you are offered the most effective deal – from the attitude of both cover and price. For young drivers, this becomes imperative, as they are typically penalized for their age and lack of driving expertise, translating into higher premiums and excesses.”

Money patrons are not exempt from the requirement to insure their new car. Thefts and hijackings are still a reality and also the growing variety of cars on the road puts all drivers at increased risk of being involved in an accident. Choosing an insurance product that’s appropriate in terms of budget, price adds, cover and excess payable is a careful call that, with the right recommendation, will be created sensibly and safely.

Many young, first-time consumers realize that purchase insurance through a direct insurer is truly a easy process.

They are possible to receive a tailored insurance resolution catering for their specific desires – with direct insurance, purchasers do not pay any additional charges for obtaining what they want. Any driver about to embark on getting a new vehicle would do well to think about the time- and value-saving benefits of direct insurance.

Is it lawful for a city police officer to stop your vehicle simply for having a valid out of state tag?

I was stopped by a city police officer in Nahunta, Georgia on a legal, public, dirt road for having a tag from Florida. The tag was valid, currently registered to the vehicle if was attached to, and my license and insurance were also valid. The officer’s exact words upon approaching my vehicle were “We have had some fires out here and when I saw your Florida tag, I wanted to know what you were doing out here.” I would like to know if this is a lawful traffic stop. Thank you.

Yes,

Give your Car Insurance a Holiday

Driving holidays are always popular, especially in Europe, and with cross-channel ferries and the Channel Tunnel being relatively cheap, holiday makers are going for this option instead of flights. The sense of freedom that comes with going on a foreign holiday in your own car is one that appeals to the more adventurous of us.

It’s common practice to take out European breakdown cover, and get your car checked out, possibly even serviced, before embarking on a long journey overseas, but a good percentage of drivers forget to check their car insurance too.

With the creation of the European Union the majority of policy holders assume that their fully comprehensive or third-party, fire and theft cover will extend into Europe. It won’t. the fact is, as soon as your wheels leave British soil, your cover stays at home, leaving you with third party cover only. This is the bare legal minimum in Europe, and will only insure you for damage to another vehicle.

Some countries are notorious for unsafe driving. Greece is known as one of the worst in Europe, while Spain and Poland tend to have more aggressive drivers than the UK, so extending your car insurance to cover all eventualities makes a lot of sense. You may pay a little more on your premium, but compare it to how much you could spend without it. Costs of being in an accident abroad can run into hundreds of pounds, all for the sake of a few pounds before you go. If you don’t go abroad often, ask your insurer to upgrade your policy just to cover you while you’re abroad.

It’s also best to carry a Green Card with you when driving abroad. This shows that you are legally insured for driving in Europe, and can be obtained from certain motor insurance companies. If you don’t want to get a Green Card, or forget, take your insurance certificate instead.

As well as extending your car insurance, there are other things to prepare for that you may not think about, especially if this is your first time driving abroad.

A GB sticker displayed on the back of your car is mandatory in most countries, as is carrying a fire extinguisher, tool kit, warning triangles, spare bulbs and a first aid kit. If you’re stopped on the road the local police will check you have these with you.

Do your research – try and learn what the various road signs mean, and find out about any local driving rules and speed limits. Remember that they may well be in kph as opposed to mph, and while a sign may read ’80′, this could be misleading in kph, as it would actually mean 50 mph. Fortunately, most speedometers in UK cars have the kph printed under the mph, so just get used to checking this before you go.

It’s also worth remembering to stay away from badly-lit car parks and side streets at night while abroad, and keep your car securely locked at all times – even when you’re in it. UK marked cars are prime targets for thieves and car-jackers, so be vigilant, never leave your unlocked car unattended and hide all valuables.

If a U.S. gay couple visits Canada, gets married there, and returns to the U.S., is their marriage recognized?

I would think the answer is yes………because:
this site: http://www.samesexmarriage.ca/legal/ontario_case/appeal/pride_week_marriage.htm
states the following:
“they will be as married as any people on the planet. That means, for example, the couples will identify as married on applications/forms for jobs, apartments, credit, mortgages, insurance, medical treatment, and taxes.”

However, if a gay couple gets married in another country besides Canada……..such as norway, spain, belgium, south africa, or the netherlands…….and then moves to the U.S…….their marriage will only be recognized in 3 states: New York, Rhode Island, New Mexico.

It seems like Canada & the U.S. have a litle tea party agreement that they recognize each other’s marriages…..but when we’re talking about a different foreign country, the rules are different.

so my question is: Does everything I just said sound accurate? Is this pretty much true?

It depends on the state, I believe in NY, CT CA,RI, NM, MA yes. It should be in the whole country though

Hlophe lawyers cost the state R6, 78m, Parliament declared that the government has spent 0.78 R6-million for Judge John Hlophe's legal fees, costs in his discussion of the constitutional court judges.

Would just add the following to Midnights excellent answer….

CYes … but often it has to an ‘approved’ type to get a reduction in insurance cost, if you’re thinking of buying one to lower premiums make sure it has an accepted rating where you live. E.g. for the UK ‘Thatcham approved’.

D the excess is the amount you have to cover yourself. So if you have a claim for 499 (or less) and the excess is 500…. you get nothing, if the claim is for 501 ….you get 1….600 you get 100… etc etc.
Obviously the higher the excess the less likely you are to claim and so the premium is cheaper.

EThe car value will affect the premium, but it’s often a very small factor. (Midnight has explained most of them) so don’t expect to see 50% difference in premium for the same car worth 10,000 or 5,000 (or even 10% probably). The real cost of insurance is related to what damage you might cause to other people/property and for that reason your driving record and the make/type of car will make much more difference than its value.
