How do I report a company if I am an employee?

First, I want to know what (if any) of the following is against the law. I work for a restaurant that pays the hosts, servers, and bar $2.17 an hour. The servers have to tip 3% of the their total sales (instead of just their tips) so servers end up tipping out half of their tips each day, which then gets distributed to the hosts and “to-go” people. Is that normal? I’ve heard from people who have worked in restaraunt businesses that this isn’t a typical thing to do. Also, they told us that we only have the option of receiving our pay-check through a prepaid visa and each person has to pay $12 a month for that visa card. We asked if we could just pick up our checks and they said that the visa card will be the only way that they will pay us from now on and that we just have to pay that $12 a month. Also, if any of this is not legal, who do I report this to?

EDIT: I live in Tennessee (USA) and it is a pizza serving restaurant, if that helps at all.

I don’t know where you work so I don’t know for certain what labor laws apply. It does seem strange but it doesn’t sound like a violation of any labor laws; At least not where I’ve lived.

If you follow the link on that page to the “Wage Regulation Act” document and read section 50-2-103(e)

“The payment of wages or compensation of employees in the employments defined herein shall be made in lawful money of the United States or by a good and valid negotiable check or draft, payable, on presentation thereof, at some bank or other established place of business, without discount, exchange or cost of collection, in lawful money of the United States, and not otherwise. ”

That paragraph seems to suggest that they cannot force you to take payment using a method that requires you to pay a cost of collection. I am not a lawyer so I can’t be certain if this is sufficient argument against their policy of paying with the Visa Card but it is certainly worth asking the Labor Department for advise.

I would also point out an additional question on the same page –

“My employer has just told me that I am going to be paid by direct deposit. Can he do this?
Yes, an employer can change the method of payment to direct deposit. However, the choice of the financial institution must be that of the employee. ”

That might also have some relevance to the Visa payments.
