i have a settlement coming up and was wondering is there a general cap on the most an insurance company would pay. No surgury involved but it was a back injury that finally resulted in arthiritus in the facet joints.

If I have to leave the country for work can I give my parents Power Of Attorney to handle law suits?
I have to leave the country off and on due to my line of work ,if I have to legal dilemas where I may be compesated money due to Malpractice ,the Hospitals lawyers want to go to court if I am unable to go can I have my parents act as my voice on my behalf or should I allow my lawyer to handle this case,I prefer to not pay someone 35% if possible so I figured my family would be the best route.
You should really ask your lawyer about this (or a different lawyer if you’re afraid he’ll just say what benefits him). You may be able to leave a notarized statement of some sort. They’ll most likely need your testimony, not through your parents.

Medical Malpractice… Tort Reform anyone?
I am applying to medical school and would love to learn more about people’s opinions regarding the outrageous medical malpractice suits.
In conjunction with tort reform, Doctor’s opinions should be less important. There needs to be a “checklist” like pilots must use before takeoff. Every heart patient for example, should have the same diagnosis plan and treatment plans throughout the country. Uniformity keeps our airways relatively safe as every pilot must follow a specific set of rules.
This type of practice will not only reduce mistakes causing injury and death due to human error but it will also reduce spiraling medical costs.

Question about dental malpractice lawsuit?
My previous dentist (in an HMO network) overprepared (removed too much tooth structure) two of my molars for a crown. The crown will not stay glued on because of it. I talked to a lawyer who said dental malpractice lawsuits are harder to prove than medical malpractice. He said the cost of the lawsuit would exceed the cost of getting it fixed. Are there any non profit attorneys that would help me sue if I can’t pay the legal fees? I want to have my previous dentist pay to get my tooth fixed by the specialist. I have to go through painful oral surgery (crown lengthening) to get the crowns to stay glued on. I am suffering severely from another dentist’s mistake. Does anyone have experience suing a dentist and winning?
Every state has a board of dentistry that licenses dentists and that is who you contact for peer review. It is a department in state government, if you do a search a result usually pops up for each state. If the dentist is licensed to practice in your state, they must comply with peer review. There is no cost to make a formal complaint and it is mandatory to investigate all complaints. You will be assigned a case investigator and they will handle the complaint. The investigator will contact you to get more information and then they will subpoena the records from your dentist. Whatever the boards decision is, the dentist (if they want to maintain their license) must comply. It won’t take longer than several months at the most to get a board decision. In my state, the board sides with the patient about 50% of the time. If you have a valid complaint, it is certainly worth writing the letter to see what the board finds.

Who can tell me about Medical Malpractice or Wrongful Death Laws in the state of Illinois?
Is it true that in the state of Illinois you have 2 years to file a Malpractice/Wrongful Death Lawsuit against a Doctor in private practice, but only 1 year to file against a Public Hospital?
Any action for personal injury or death against a physician or hospital must be filed within two years from the date the claimant knew or reasonably should have known of the injury. In no instance may a claimant bring an action more than four years after the date on which the alleged act or omission occurred.
If the claimant was under the age of eighteen when the cause of action accrued, the limitation period is eight years from the date of the alleged act or omission, except that in no event may such an action be filed after the minor claimant’s 22nd birthday. If the claimant is mentally incompetent, the period of limitations does not begin to run until the disability is removed.
Wrongful death actions are governed by a different two-year statute of limitations that begins to run on the date of death. However, such an action can only be brought if, on the date of death, the decedent could still have commenced a malpractice action for the injury that caused the death.
In addition, the limitations period in actions brought against a local entity or its employees (e.g., a public hospital) is reduced to one year from the date the injury was received or the cause of action accrued. This takes the place of the ordinary medical malpractice statute of limitations when you’re dealing with public entities.
